Fort Lupton council bans residents from growing marijuana for sale

FORT LUPTON — The Fort Lupton city council unanimously approved an ordinance Feb. 3 banning residents from growing marijuana for sale.

“Basically, it’s establishing that growing marijuana for sale or for retail dispensaries is not allowed here,” City Administrator Claud Hanes said.

The measure revises chapter 10 of the municipal code dealing with “General Offenses.”

The Weld County Board of Commissioners approved a similar measure a year ago banning the “growth, manufacturing and sale of marijuana in unincorporated areas of the county.”

Amendment 64, which was passed by state voters in 2012, allows citizens to possess and grow marijuana for personal use, but the amendment also gives municipalities the right to place a moratorium on recreational marijuana business operations.
